OVERVIEW

Welcome to ThingsForge. The terms "we," "us," and "our" refer to ThingsForge. ThingsForge operates this store and website, including all related information, content, features, tools, products and services (the "Services"). ThingsForge is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them (these "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. They include important information about your legal rights, including warranty disclaimers, limitations of liability, and important information about how our 3D-printed products are made and intended to be used.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access the Services.


SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and that you consent to any of your minor dependents using the Services on devices you own, purchase, or manage.

To use the Services — including browsing our store or purchasing products — you may be asked to provide information such as your email address and billing, payment, and shipping details. You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign, or license your account to any other person.


SECTION 2 — OUR PRODUCTS

How our products are made. ThingsForge products are 3D printed, typically in small batches or made to order after you place your order. Each piece is produced individually and finished by hand.

What that means for you. Because of the nature of additive manufacturing, you should expect minor variation between individual pieces. This includes visible layer lines, small differences in surface texture or finish, slight variation in color between print runs and filament batches, and dimensional tolerances of approximately ±0.5mm. These characteristics are inherent to the process and are not defects.

We are, of course, still on the hook for actual defects. Failed prints, warping, incomplete layers, structural flaws, cosmetic damage, and anything that doesn't match its product description are covered in full by our Refund Policy.

Colors and images. We make every effort to represent our products accurately. Colors and appearance may nonetheless differ from what you see on your screen, depending on your device, display settings, and lighting. Product photographs and renderings are representative rather than exact.

Availability. All product descriptions are subject to change at any time at our discretion. We reserve the right to discontinue any product at any time, and to limit the quantities of any product we offer to any person, geographic region, or jurisdiction on a case-by-case basis.


SECTION 3 — PRODUCT USE AND SAFETY

Please read this section. It describes what our products are and are not built for.

Unless a specific product page expressly states otherwise:

Decorative and hobbyist use only. Our products are intended for decorative, display, and general hobbyist use. They are not engineered, tested, or certified for structural, load-bearing, weight-supporting, mechanical, medical, automotive, electrical, marine, or industrial applications, and must not be used as or as part of any safety device, personal protective equipment, or life-critical system.

Not food-safe. Our products are not food-safe and must not be used to prepare, serve, store, or come into contact with food or drink. The layered surfaces created by 3D printing can harbor bacteria that ordinary washing does not remove. Our products are not dishwasher-safe or microwave-safe.

Not children's toys. Our products are not toys and are not designed, tested, or certified to any children's product safety standard, including the CPSIA. Many contain small parts, thin projections, or removable components that present a choking or injury hazard. They are not intended for children under 14 and should be kept out of reach of young children and pets. Adult supervision is required around children of any age.

Heat, sunlight, and weather. Most of our products are printed in PLA or PLA+, which softens and deforms at temperatures above roughly 55°C / 130°F. Do not leave them in a parked car, near a heat source, on a windowsill in direct sun, or in a dishwasher. Prolonged UV exposure causes discoloration and embrittlement over time. Unless a product page states that a piece is rated for outdoor use, treat it as an indoor product.

Care. Clean with a dry or barely damp soft cloth. Avoid solvents, alcohol, abrasives, and submersion.

Assumption of risk. You are responsible for determining whether a product is suitable for your intended use. We are not liable for injury, damage, or loss resulting from use of a product outside its intended purpose as described above or on the product page.


SECTION 4 — ORDERS

When you place an order, you are making an offer to purchase. ThingsForge reserves the right to accept or decline any order at its discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before an order is accepted.

Production time. Many of our products are printed after you order. The production time shown on the product page or at checkout is an estimate of how long we need before your order ships, and is separate from shipping transit time.

Changes and cancellations. Please review your order carefully before submitting it. We will do our best to accommodate changes or cancellations, but once a print has started we may be unable to. Contact us as soon as possible at info@thingsforge.com if you need to change something.

If we decline, change, or cancel an order, we will attempt to notify you using the email address, billing address, or phone number provided at the time of the order, and will refund any payment taken.

Your purchases are subject to return or exchange in accordance with our Refund Policy.


SECTION 5 — CUSTOM AND PERSONALIZED ORDERS

Some products can be customized, personalized, or made to your specification. Additional terms apply to these orders.

Your designs and content. If you supply artwork, text, models, photographs, logos, names, or any other material for a custom order, you represent and warrant that you own that material or have all rights and permissions necessary to have it reproduced, and that reproducing it will not infringe any copyright, trademark, right of publicity, or other right of any third party. You agree to indemnify us for any claim arising from material you supply.

Our discretion. We may decline any custom request for any reason, including requests we believe may infringe a third party's rights or that we are not equipped to produce well. If we decline after payment, we will refund you in full.

Approval and accuracy. Where we provide a proof, mockup, or written spec for your approval, please check it carefully — particularly spelling, names, dates, and dimensions. Once you approve it, we print what was approved. We cannot refund a custom piece because of an error carried over from an approved proof.

Returns. Custom and personalized pieces cannot be returned for change of mind, because they cannot be resold. Our full guarantee still applies: if a custom piece arrives damaged or defective, or does not match the spec you approved, we will reprint it or refund you. See our Refund Policy.


SECTION 6 — PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as set out in your order confirmation email. Unless expressly stated otherwise, posted prices do not include taxes, shipping, handling, customs, or import charges.

Prices in our online store may differ from prices offered in physical stores or through third-party marketplaces where our products also appear. We may run promotions governed by their own terms; where those terms conflict with these Terms, the promotion terms govern for that promotion.

You agree to provide current, complete, and accurate purchase, payment, and account information, and to update it promptly — including your email address and card details — so that we can complete your transactions and reach you when needed.

You represent and warrant that the payment information you provide is true, correct, and complete; that you are authorized to use the payment method; that charges you incur will be honored by your card issuer; and that you will pay all charges at the posted prices, including shipping, handling, and applicable taxes.


SECTION 7 — SHIPPING AND DELIVERY

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, customs processing, or other events outside our control. Title and risk of loss pass to you when we transfer the products to the carrier.

That said: we do not use this section to walk away from a damaged package. If your order arrives damaged, or does not arrive at all, our Refund Policy governs, and we will replace or refund the order as described there. Nothing in this section limits the commitments we make in the Refund Policy.


SECTION 8 — INTELLECTUAL PROPERTY

Our Services. The Services — including all trademarks, brands, text, displays, images, graphics, product photography, video, audio, and the design, selection, and arrangement of them — are owned by ThingsForge, its affiliates, or its licensors, and are protected by U.S. and foreign copyright, trademark, patent, and other intellectual property laws.

Designs by independent artists. Some products sold through the Services incorporate designs created by independent artists and designers and used by ThingsForge under license. Those designs remain the property of their respective creators, who are credited on the applicable product page. We are grateful to work with them, and we ask that you respect their rights as you would ours.

What you may not do with a product you buy. Buying a physical product from us transfers ownership of that physical object only. It does not grant you any rights in the underlying design. You may not scan, photogrammetrically capture, 3D model, mold, cast, reverse engineer, or otherwise reproduce any product purchased from us, or produce derivative works from it, for reproduction, distribution, or sale.

What you may do. Enjoy it, display it, photograph it, gift it, and post pictures of it. Personal photographs of a product you own are entirely fine, and we'd love to see them.

Site content. These Terms permit you to use the Services for your personal, non-commercial use. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent. Except as expressly provided here, nothing in these Terms grants any license or right under any patent, trademark, copyright, or other intellectual property of ThingsForge, Shopify, or any third party. All rights not expressly granted are reserved.

ThingsForge's names, logos, product and service names, designs, and slogans are trademarks of ThingsForge or its affiliates or licensors, and may not be used without our prior written permission. Shopify's name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, and marks on the Services are the trademarks of their respective owners.

If you think we've gotten this wrong. If you believe a product or any content on the Services infringes your intellectual property rights, please contact us at info@thingsforge.com with a description of the work and where it appears. We take this seriously and will investigate promptly.


SECTION 9 — OPTIONAL TOOLS

You may be given access to third-party tools through the Services that we neither monitor nor control.

You acknowledge and agree that we provide access to such tools "as is" and "as available," without any warranties, representations, or conditions of any kind and without endorsement. We have no liability arising from or relating to your use of optional third-party tools. Your use of them is entirely at your own risk and discretion, and you should make sure you are familiar with and approve of the terms on which the relevant third-party provider offers them.

We may offer new features through the Services in the future. Any such features are part of the Services and are subject to these Terms.


SECTION 10 — THIRD-PARTY LINKS

The Services may contain materials and links to websites operated by third parties, including embedded third-party functionality. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites. If you leave the Services to access them, you do so at your own risk.

We are not liable for any harm or damages related to your access of third-party websites, or your purchase or use of any products, services, resources, or content on them. Please review the third party's policies and practices before engaging in any transaction. Complaints, claims, or questions regarding third-party products and services should be directed to that third party.


SECTION 11 — RELATIONSHIP WITH SHOPIFY

ThingsForge is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with ThingsForge. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and ThingsForge, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with ThingsForge.


SECTION 12 — PRIVACY

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit will be transmitted to and shared with Shopify, as well as third parties that may be located in countries other than where you reside, in order to provide services to you. See our Privacy Policy for details on how we, Shopify, and our partners use your personal information.


SECTION 13 — REVIEWS AND FEEDBACK

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, photographs, proposals, or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium for any purpose, including commercial use — for example, to operate, evaluate, improve, and promote the Services.

You represent and warrant that: (i) you own or have all necessary rights to the Feedback; (ii) you have disclosed any compensation or incentive received in connection with it; and (iii) it complies with these Terms. We have no obligation to keep Feedback confidential, to compensate you for it, or to respond to it.

We may, but are not obligated to, monitor, edit, or remove Feedback we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, obscene, or otherwise objectionable, or that violates any party's intellectual property rights or these Terms.

You agree that your Feedback will not violate any third-party right, including copyright, trademark, privacy, or personality rights; will not be libelous, abusive, obscene, or otherwise unlawful; and will not contain any virus or malware. You may not use a false email address, impersonate anyone, or otherwise mislead us or others as to the origin of any Feedback. You are solely responsible for your Feedback and its accuracy. We assume no liability for Feedback posted by you or any third party.


SECTION 14 — ERRORS, INACCURACIES, AND OMISSIONS

Occasionally there may be information in the Services containing typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct any such error and to change or update information, or cancel orders, if any information is inaccurate — at any time and without prior notice, including after you have submitted your order. If we cancel an order for this reason, we will refund you in full.


SECTION 15 — PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, provincial, state, or local law, rule, regulation, or ordinance; (c) to infringe our intellectual property rights or those of others, including by reproducing our products or the designs of the artists we work with; (d) to harass, abuse, insult, harm, defame, slander, disparage, or intimidate any person; (e) to transmit false or misleading information; (f) to send, receive, upload, download, use, or re-use any material that does not comply with these Terms; (g) to transmit any advertising or promotional material, including junk mail, chain letters, or spam; (h) to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or that may harm ThingsForge, Shopify, or users of the Services, or expose them to liability.

You also agree not to: (a) upload or transmit viruses or other malicious code; (b) reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, pretext, spider, crawl, or scrape; or (e) interfere with or circumvent the security features of the Services or any related website.

We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.


SECTION 16 — TERMINATION

We may terminate this agreement or your access to the Services (or any part of them) at our sole discretion at any time without notice. You will remain liable for all amounts due up to and including the date of termination.

The following sections survive termination: Our Products, Product Use and Safety, Custom and Personalized Orders, Intellectual Property, Reviews and Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, and Privacy — along with any other provision that by its nature should survive.


SECTION 17 — DISCLAIMER OF WARRANTIES

The information presented on or through the Services is made available for general information purposes only. We do not warrant its accuracy, completeness, or usefulness. Any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY ThingsForge — INCLUDING THE COMMITMENTS WE MAKE IN OUR REFUND POLICY — THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY REPRESENTATION, WARRANTY, OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE ABOVE MAY NOT APPLY TO YOU.

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited under the consumer protection laws applicable to you.


SECTION 18 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL ThingsForge, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS — OR THOSE OF SHOPIFY AND ITS AFFILIATES — BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PROCURED THROUGH THEM, OR FROM ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT — INCLUDING ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT OR PRODUCT MADE AVAILABLE VIA THE SERVICES — EVEN IF ADVISED OF THEIR POSSIBILITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR ANY PRODUCT SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ThingsForge FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, PERSONAL INJURY, OR DEATH, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. NOTHING IN THIS SECTION LIMITS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR ANY LIABILITY THAT CANNOT LAWFULLY BE LIMITED.


SECTION 19 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless ThingsForge, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, payable to any third party arising out of (1) your breach of these Terms or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, (3) any material you supply to us for a custom order, or (4) your access to and use of the Services.

We will notify you of any indemnifiable claim, provided that a failure to notify promptly will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such a claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent, which will not be unreasonably withheld. You will cooperate in the defense of indemnified claims, including by providing relevant documents.


SECTION 20 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed. Such a determination shall not affect the validity or enforceability of the remaining provisions.


SECTION 21 — WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms, together with any policies or operating rules we post on this site, constitute the entire agreement between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, including any prior version of these Terms.

Any ambiguity in the interpretation of these Terms shall not be construed against the drafting party.


SECTION 22 — ASSIGNMENT

You may not delegate, transfer, or assign these Terms or any of your rights or obligations under them without our prior written consent, and any such attempt is null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without your consent or notice to you.


SECTION 23 — GOVERNING LAW AND VENUE

These Terms and any separate agreements under which we provide you Services are governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. You and ThingsForge consent to the exclusive venue and personal jurisdiction of the state and federal courts located in Jackson County, Missouri for any dispute arising out of or relating to these Terms or the Services.

Nothing in this section deprives you of the protection of any mandatory consumer protection law of the jurisdiction in which you reside, or of your right to bring a claim in small claims court.

The headings in this agreement are included for convenience only and do not limit or otherwise affect these Terms.


SECTION 25 — CHANGES TO THESE TERMS

You can review the most current version of these Terms at any time on this page.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically. We will notify you of material changes in accordance with applicable law, and such changes will take effect on the date specified in the notice. Your continued use of or access to the Services after changes are posted constitutes acceptance of those changes.
